11. Returns, Refunds and Warranty Policy
11.1 General Policy
TDSA values customer satisfaction and complies with the Consumer Protection Act, 68 of 2008 (CPA). Returns, refunds, and warranty claims are handled fairly and in accordance with the procedures below.
11.2 Return Eligibility
TDSA will only accept returns for goods that:
• Are defective, damaged, or not as described; or
• Were delivered in error by TDSA; or
• Are returned in their original, unopened, unused, and resaleable condition within seven (7) calendar days of purchase, subject to management approval and a 10% handling fee.
Goods that are used, damaged through misuse or neglect, not in their original packaging, or not in a resaleable condition will not be accepted for return unless the product is proven defective under warranty.
11.3 Non-Returnable Items
The following items are not eligible for return or refund:
• Custom-made, branded, or personalised products.
• Back or Special-Ordered items (including all Brownells and Rothco products).
• Used or pre-worn items, which are sold voetstoots (as is).
• Budget “Chinese-made” products sold as entry-level items.
• Items damaged due to misuse, neglect, or improper use.
11.4 RMA (Return Merchandise Authorisation) Procedure
All returns must be accompanied by an RMA number issued by TDSA.
To request an RMA number, customers must contact TDSA within seven (7) calendar days of purchase by emailing help@tdsa.co.za with the following information:
• Customer name and contact details
• Order or invoice number
• Product details and description of the issue
• Clear photographs (if applicable)
No goods will be accepted without a valid RMA number. Customers returning goods by courier must ensure items are packaged securely to prevent damage in transit.
11.5 Assessment and Processing
Upon receipt, TDSA will inspect the returned goods and notify the customer of the assessment outcome. Where a defect or error is confirmed, one of the following remedies will apply at TDSA’s discretion:
• Repair: The product will be repaired at no cost if possible.
• Replacement: If repair is not viable, the product will be replaced with the same or an equivalent model.
• Store Credit: If repair or replacement are not possible and TDSA cannot offer a reasonable alternative, the customer may elect to receive store credit for the value of the item. No handling fee will apply to store credit issued for defective goods.
• Refund: If any repair or replacement are not possible and the customer does not wish to accept store credit, a refund may be requested. If requested and approved, a 20% handling fee will apply.
If no defect is found, or the issue results from misuse, fair wear and tear, or damage caused by the customer, TDSA will notify the customer. The product may then be returned to the customer at their cost.
11.6 Refunds
Approved refunds will be processed within fourteen (14) business days from the date of approval. Refunds exceeding R20 000 may take longer. For online orders, TDSA will endeavour to refund via the original payment method where possible. For other transactions, refunds will be made via EFT to the bank account provided by the customer.
TDSA cannot be held liable for delays or errors arising from incorrect banking details supplied by the customer. Customers are solely responsible for recovering any funds paid into incorrectly supplied banking details.
11.7 Customer Responsibilities
Customers are responsible for:
• Providing accurate order and contact information.
• Ensuring items are properly packaged for return shipping.
• Bearing courier costs for non-defective returns unless otherwise agreed in writing.
11.8 Warranty Coverage
All products supplied by TDSA are covered against manufacturer’s defects in accordance with the relevant manufacturer’s warranty. Warranties do not cover normal wear and tear, misuse, modification, or damage due to negligence. Warranty claims must be submitted within the product’s warranty period and accompanied by proof of purchase.
11.9 Special Product Categories
• Brownells Products: Ordered on special request only. Customers must verify compatibility prior to purchase. No returns or refunds are accepted for incorrect orders.
• Rothco Products: Ordered on special request only. Customers must confirm size, colour, and style prior to purchase. No returns or refunds for incorrect selection.
• Chinese-Made Budget Products: These are sold as affordable, entry-level items without warranty. Quality and performance may vary. Purchase is at the customer’s own risk.
11.10 Exclusions and Limitation of Liability
TDSA accepts no responsibility for indirect or consequential damages arising from product use, misuse, or delays in returns processing. The maximum liability of TDSA under any return, refund, or warranty claim is limited to the total value of the goods in question.
12. Sale of Goods – General Terms
12.1 General Conditions
All prices include VAT unless otherwise stated and exclude shipping unless otherwise indicated.
Prices are subject to change without prior notice. Stock availability and ETAs are provided in good faith but not guaranteed.
All products remain the property of TDSA until paid for in full. Orders are only processed once payment has been received and verified.
12.2 Quotations and Pricing Validity
All quotations are valid for seven (7) calendar days from the date of issue unless otherwise stated in writing.
Pricing, availability, and exchange rate conditions are subject to change thereafter.
TDSA reserves the right to apply minimum order values or handling fees for low-value transactions.
Quoted pricing is based on the total quantities and overall value specified in the quotation. Should the customer decide to proceed with a reduced quantity or order value that differs from the original quotation request, the quotation will no longer be valid. TDSA reserves the right to revise and reissue the quotation accordingly.
When quoting, all pricing is based on the assumption that the quotation is issued to a South African–registered entity. If the entity requesting the quotation is a non–South African entity and/or qualifies for VAT exemption, they must inform TDSA in writing before the quotation is issued so that pricing can be adjusted accordingly. Should a customer notify TDSA after a quotation has been issued that they are a non–South African entity and/or VAT exempt, TDSA reserves the right to withdraw, revise, or reissue the quotation. In such cases, the original quotation will be deemed invalid.
12.3 Exchange Rate (ROE) Adjustments
Where a quotation or order is based on a specific currency rate of exchange (ROE), TDSA reserves the right to adjust the final price if the exchange rate increases by more than 1% between the quotation date and the date of final invoicing.
Any adjustment will be applied proportionately to the affected items, reflecting the actual change in procurement cost resulting from the exchange rate fluctuation.
Example: If the quoted ROE increases by 5% by the time of final invoicing, the affected item prices will increase by the same 5% to reflect the higher procurement cost.
For quotations valid longer than 14 days or related to tenders, framework, or project-based pricing, TDSA reserves the right to review and amend pricing if material cost factors (including currency exchange rates, freight, or supplier pricing) change prior to order confirmation.
12.4 Payment Terms
Payment for website orders may be made via approved payment gateways including PayFast, PayGate, PayJustNow, Stitch Express, Ozow, and Yoco.
Bulk or wholesale orders must be paid by EFT or direct bank deposit.
All goods remain the property of TDSA until payment has been received in full and cleared.
In the event of non-payment, dishonoured transactions, or chargebacks, TDSA reserves the right to suspend future orders, recover costs, and claim reasonable collection fees and interest at the maximum rate permitted by law.
12.5 Stock and Lead Times
TDSA endeavours to maintain stock of popular items; however, due to the breadth of its product range, not all products are held in stock at all times.
Backorders will be confirmed with the customer and are subject to supplier availability and import timelines.
Lead times for backordered items can range from 2 to 6 weeks under normal circumstances but may extend up to 6 months for specialised or imported products.
12.6 Risk and Delivery
Risk in the goods shall pass to the customer upon collection by, or delivery to, the customer or their nominated carrier, whichever occurs first.
TDSA will not be responsible for any loss, damage, or delay once goods have been handed to the carrier.
Customers are encouraged to arrange adequate transit insurance.
Collection or delivery may only occur after TDSA has confirmed that payment has been received and cleared.
Customers are responsible for ensuring correct contact details and must await confirmation before dispatching a courier or collecting orders.
12.7 Order Cancellations
Orders for in-stock items may be cancelled prior to dispatch subject to management approval.
Orders for backordered or special-order items may not be cancelled once placed. If cancellation is approved, a 20% handling fee will apply to cover administrative and supplier costs.
12.8 Errors and Omissions
While every effort is made to ensure accuracy, all prices, images, and product information are subject to availability and final verification.
E&OE (Errors and Omissions Excepted).
13. Force Majeure
TDSA shall not be held liable for failure to perform due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, acts of government, war, or supply-chain disruptions.
Warranty assessment and processing times may vary depending on supplier policies or import logistics. TDSA will keep customers informed of progress but cannot be held liable for delays beyond its reasonable control.
14. Communication Protocol
All formal communications, including notices, order confirmations, and cancellations, must be in writing and sent via email to help@tdsa.co.za or another authorised address. Verbal communications will not be binding unless confirmed in writing.
15. Entire Agreement
These Terms and Conditions constitute the entire agreement between TDSA and the user, superseding all prior representations or agreements.
